1. Parties and acceptance
These Terms & Conditions ("Terms") govern access to and use of the Mosarat Auto Parts ("Mosarat", "we", "us") website, customer portal, quotation tools, and related services available at www.mosaratautoparts.com (the "Platform"). By creating an account, submitting an RFQ, accepting a quotation, or placing an order, you ("Customer", "you") agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Nature of the Platform
Mosarat operates a UAE-based digital sourcing and export facilitation platform for genuine and aftermarket automotive spare parts. Unless expressly agreed in a signed written contract, Mosarat acts as seller/exporter of record for accepted and paid orders. Product descriptions, OE numbers, and fitment guidance are provided in good faith; it remains the Customer's responsibility to verify suitability for the intended vehicle and market regulations.
3. Accounts and acceptable use
You must provide accurate registration and RFQ information. You are responsible for safeguarding login credentials and for all activity under your account. You must not misuse the Platform (including scraping, unauthorized access, submission of fraudulent RFQs, or attempts to circumvent payment or return controls). Mosarat may suspend or terminate accounts that breach these Terms or create legal, operational, or credit risk.
4. RFQs and quotations
RFQs are invitations to treat and do not create a binding supply obligation. Quotations are valid only for the period stated on the quotation (or seven (7) days if unspecified) and may be withdrawn or revised prior to acceptance. Prices, availability, lead times, and shipping estimates are subject to supplier confirmation and market conditions. Currency, Incoterms (if any), and payment terms stated on the quotation prevail for that transaction.
5. Orders and payment
Acceptance of a quotation creates an order subject to full payment before procurement and dispatch, unless Mosarat agrees otherwise in writing. Title to goods passes only upon receipt of cleared funds. Online payments are processed by third-party providers (e.g. Stripe); their terms apply to card processing. Mosarat is not liable for delays caused by payment provider outages, bank declines, or incorrect Customer payment details.
6. Shipping and delivery
Shipping charges, carriers, and estimated transit times are indicative. Risk of loss passes according to the shipping arrangement stated on the quotation/invoice (typically upon handover to the carrier for export consignments). Tracking information, when provided, is supplied by the carrier; Mosarat is not responsible for carrier delays, customs holds, duties/taxes in the destination country, or incorrect delivery addresses supplied by the Customer. Destination import duties, VAT, and clearance fees are the Customer's responsibility unless expressly included.
7. Returns and refunds
Returns are accepted only within three (3) working days (UAE working week: Sunday–Thursday), measured from the payment confirmation date unless Mosarat states otherwise in writing. If a return is accepted, any refund shall cover parts cost only. Shipping, handling, export packing, payment processing fees, and duties are non-refundable. Refunds are initiated only after the product has been returned to Mosarat's warehouse in Dubai (or other location designated by Mosarat) and receipt has been confirmed by the Mosarat sales team. Goods must be unused, in original packaging, and in resalable condition, unless Mosarat confirms a defect attributable to Mosarat or its nominated supplier. Mosarat may reject returns that are late, incomplete, damaged, or outside policy.
8. Warranties and limitation of liability
To the maximum extent permitted by applicable UAE law, the Platform and goods are provided on an "as available" basis. Manufacturer warranties (if any) are passed through where available; Mosarat does not expand manufacturer warranty terms. Mosarat's aggregate liability arising out of any order shall not exceed the parts amount actually paid for that order (excluding shipping). Mosarat shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, downtime, or third-party claims, whether based in contract, tort, or otherwise, even if advised of the possibility. Nothing in these Terms excludes liability that cannot be excluded under mandatory UAE law.
9. Intellectual property
All Platform content, trademarks, logos, software, and documentation remain the property of Mosarat or its licensors. You receive a limited, non-exclusive, non-transferable licence to use the Platform for legitimate RFQ and order activity. Brand names and OE part numbers of third parties are used for identification only and do not imply affiliation unless stated.
10. Force majeure
Mosarat is not liable for failure or delay caused by events beyond reasonable control, including supplier failure, carrier disruption, customs actions, sanctions, epidemic, cyber incidents, or utility failure.
11. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. The courts of Dubai shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms or any order, without prejudice to Mosarat's right to seek interim relief in any competent jurisdiction.
12. Changes
Mosarat may update these Terms by posting a revised version on the Platform. Continued use after posting constitutes acceptance of the updated Terms for future transactions. Material changes to an already-accepted quotation require mutual confirmation.
